Terms of Service
In plain terms: Ms. Vibecode is a tool you install and run on your own computer. Buy a license to keep using it after the trial. It's provided as-is, you're responsible for your own keys and machine, and payments/refunds are handled by Lemon Squeezy.
These Terms of Service ("Terms") are an agreement between you and the maker of Ms. Vibecode ("we", "us") governing your use of the Ms. Vibecode desktop application ("the app") and the msvibecode.com website. By downloading, installing, or using the app, you agree to these Terms. If you don't agree, don't use the app.
1. Your license
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to install and use the app for your own development work, whether personal or commercial. A purchased license is intended for use by one person across their own devices.
2. Free trial
The app includes a free trial period so you can evaluate it before buying. When the trial ends, some features are gated until you activate a paid license. We may change the length or terms of the trial for future releases.
3. Purchases, payments, and refunds
Licenses are sold through Lemon Squeezy, our payments provider and merchant of record. Your purchase is also subject to Lemon Squeezy's terms. A license is a one-time purchase for the version line you buy into; we'll say clearly if a future major version ever requires a new license.
Because you can fully evaluate the app during the free trial before paying, we handle refund requests in good faith on a case-by-case basis through Lemon Squeezy. If something isn't working, email us first — we'd rather fix it.
4. What you agree not to do
- Resell, sublicense, rent, or redistribute the app or license keys.
- Share, publish, or circumvent the license mechanism to avoid paying.
- Reverse-engineer the app except to the limited extent that law expressly permits.
- Use the app to break the law or to violate the terms of the third-party services you connect to it.
5. Your responsibilities
The app stores your provider API keys, encrypted, on your own device. You are responsible for:
- Keeping your computer and operating-system account secure.
- The API keys you add and any activity performed with them against third-party providers.
- Complying with the terms and usage limits of every third-party service you connect.
We never receive your keys and cannot recover, reset, or access them for you.
6. Updates
The app can check for and install updates automatically to deliver fixes and improvements. By using the app you consent to it receiving updates. We may add, change, or remove features between versions.
7. Third-party services
Ms. Vibecode works by connecting to third-party provider APIs that you choose, and uses Lemon Squeezy for payments and GitHub for update delivery. We are not responsible for those services, their availability, or their content. Your use of them is governed by their own terms.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its status readings are complete or accurate. You use it at your own discretion and risk.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid for your license in the twelve months before the claim.
10. Termination
These Terms apply for as long as you use the app. We may suspend or end your license if you materially breach them. You can stop using the app at any time; the "as is" disclaimer and liability limits survive termination.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the date at the top and post the new version here. Continuing to use the app after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Orlando, Florida.
